The term of your service agreement will be specified in your contract. Either party may terminate the agreement for a material breach by the other party. Upon termination, you must cease using our services, and any outstanding fees become immediately due.

Modo Networks retains all intellectual property rights in our services. You may not reproduce, distribute, or create derivative works based on our services without our express written permission.

8.    Limitation of Liability

To the extent permitted by law, Modo Networks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

 

9.    Governing Law and Dispute Resolution

These Terms are governed by the laws of the state of Texas. Any disputes arising out of or relating to these Terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

 

10.   Changes to Terms

Modo Networks may update these Terms from time to time. We will notify you of any changes by posting the new Terms on our website. Your continued use of our services after the effective date of the changes constitutes acceptance of the modified Terms.
